I posted in the new members section how I bought 2 pleos. One new and one 2nd hand on ebay.
My 2nd hand arrived today and collecting him tomorrow. I just received a message on ebay that the other seller forgot to post it and is on vacation for 2 weeks.
I sent an email back asking if the pleo "new" has never been opened etc. It has new in box. I paid 170 plus 20 postage USD. 99 and 20 USD for the 2nd hand. Good deals I think considering I am in Australia.

My issue is if infact there is a problem with the pleo that is new. Paypal gives you 45 days from purchase date. If they post it in 2 weeks thats nearly 35 days. Maybe I should ask them to express it?

If it doesn't arrive by 44 days should I open a dispute just incase? The seller seems lovely but I am a very cautious person.  :(

Yes, I would raise dispute in Paypal if it's not with you in time.  You don't have to escalate it and you can always close it if and when Pleo arrives safe and as described.  Why not explain your fears to the seller and tell them that's what you'll do, just in the way you've explained it here, for your own protection.  That way they will have been warned and shouldn't take offence and turn nasty.  If you can be understanding about them forgetting to post it, I think they should be equally so over your fears.  Hope it all works out. :)

Thanks, I sent another explaining my concern and told them to enjoy their vacation we all make mistakes. I have been stressing someone might have pinched it as our fence has fallen down and I am on a main road. Walk by and grab it. It's a shame as I wanted to start working on a duet skit soon. I will have to focus on exams instead  :D

Hopefully they will understand.

They'd be very unreasonable not to, especially as you've been so nice about their error - many buyers would not have been.  Waiting for a Pleo to arrive is hard enough as it is, without adding an extra fortnight!  At least you're getting your hands on one of them, and you have luvverley exams to take your mind off the wait! :P :D

LIDDLEONE, Do not worry about the time frame, even though the seller gives you 45 days if there is a dispute about it's condition. Due to the fact that the seller will be away for 2 weeks, it is NOt the sell date, but the date the Pleo is actually mailed to you, or Postmarked. I WOULD ALSO THINK BEING INTERNATIONAL, YOU ARE GIVEN MORE TIME. I have been selling on ebay since March 2004, and have sold many places overseas, The U.K, Norway, Sweden, Canada, Germany, Spain, Italy, Malta, and lots of things sold to Austrailai. The only country I have ever had a problem with is Italy and esp Malta which are very very slow in their delivery. I have never had a problem when sending to Austraila and I would think you should get your Pleo in pretty fast time. :D As for your rights, if this is the New one, make sure your Pleo is exactly as described. Also the timeframe of 45 days doesnt start from when the seller says " mailed" , but the actual postmarked date, and you should also have tracking included to track your package. Ebay also has changed their rules in regards to ' rights:", and the seller used to have more rights than the customer. Now if you are not satisfied with your package for any reason, you can return it, ( less shipping costs, ) no questions asked, Ebay is there to protect the customer and you do not have to worry about the 45 day rule. ( Look on ebay, under Buyers rights, and also opening a dispute.)
             If I were you I would make sure to let the post office know, do not leave package on doorstep, etc, if you are worried about theft. If the seller has not left on their trip yet, email them and ask for a signatute required. It may cost another dollar or two but is worth the cost of theft or worry.I worry about theft also and UPS has a nasty habit of leaving packages on my doorstep, one reason I use a Post office box so I know things are secure.

 I never got a reply. If I had got the 2nd hand one first I wouldn't have bought two. Money reasons, time to play with them etc etc. But I'll still take it that way people can take one out.

Doesn't matter if you got a reply, you've done your best.  Anyway, the seller may have gone away already and missed it? I know Ebay have beefed up their customer protection recently, but if you've paid using Paypal you might as well use their protection - they are the ones who control the money after all!

I am thinking of asking for a refund as I couldn't afford it to begin with. I have a 2nd hand pleo and that's more than enough for me. I did want to make them sing the lion king and aladdin duets though. I have access to another pleo though. Maybe I should just get it. It was a good price but they didn't answer about it being new.

Also I got another toy with postage $35 USD on April 6th. It hasn't arrived. I asked for the shipping number but they said it was more to track it.  ??? Surely that would include tracking.

It was a Buzz Lightyear original 1995 doll. I want a woody too. Just since a kid always wanted the orignal toys. I am considering opening a dispute. It's been 31 days. Also they said on the 19th they posted it last week. Took them over a week to post it. I thought it was mandantory to be tracked. They didn't offer shipping to Aus but I asked.

liddleone, HI, like I mentioned before, I am a seller on ebay and have been buying and selling since 2004. This is how I acquired Nova, bought her on ebay at Christmas time. first as far as tracking goes, it does not cost very much  at all, I include it FREE with ALL OF MY ITEMS I SELL AS A COURTESTY, AS A WAY TO SAY THANK YOU, AND MOST IMPORTANT OF ALL, TRACKING PROTECTS THE SELLER, SHOWS PROOF OF MAILING AND LETS THE CUSTOMER TRACK THEIR PACKAGE,  Tracking only cost me about 18 Cents for all my packages,  how Expensive is that..? :I allways ask for tracking on my packages if the seller doesn't offer it, and I have never had a seller refuse to offer it to me either.

               If you haven't heard from this buyer who you bought the New Pleo off, I would guess they are on vacation. Like I said before, your 45 days you don't have to worry about, it only starts AFTER THE PACKAGE IS SHIPPED, POSTMARKED, AND IF IT IS INTERNATIONAL, DON'T WORRY, YOU HAVE LONGER. s Some places ship a lot quicker than others, and Au. is one of the quicker ones. What I would do if I were you is this.
         Wait till you get your Pleo, ( of course wait to find out the date it was shipped, the Seller is obliged to tell you when it is / was shipped if they haven't yet.) Once you get your Pleo, you can either keep the pleo, or of course, Relist it yourself either on ebay and you will have no problem selling it, you can even include a skit on SDC card if you want and have one, or keep it for awhile and sell it as used later on, Christmas is allways a great time for selling and you may get a higher price. It doesn't' make any sense to try to cancel the " auction' without having a good reason, such as accidentally hit the wrong button, ( like a price button, ) not weeks later because you need the money, etc. If you want to get the most money you can for your New Pleo when it does come, dont' even open it, except Maybe to inspect it, but if you do ,what I would do is to videotape opening it when it arrives,etc, and if anything is wrong it is documented. Also you will have photos for if and when you want to re-sell it. Good-luck with what you decide. You can P.M. Me anytime yoy want and I will be very happy to help you with EBAY questions.

RWM I was more concerned with the non-pleo item.

Strangely I just got an email saying that the pleo was no longer available and I would get a refund. Supposely they were on holiday for a while longer? Nothing makes sense to me with this seller. I have asked for an explanation. Seems very odd suddenly the item is missing/gone.

Should I just accept the refund? I felt like I was getting stuffed around which is why I posted on here. I waited 4 weeks and went from not wanting it to wanting it again waiting.. waiting.. waiting..

I guess I can always put the money aside for a newer pleo./life form  %) %) I really wanted to make duets.

Edit: I've been refunded butn since the exchange rate has changed I am out $20   >:(
And relisted the item on ebay! I am filing a dispute.

It IS annoying when you don't get a proper explanation, but personally I'd grab the refund and be thankful that you're no longer having to deal with a less-than-helpful seller.  You can always get another one - maybe one of the 2010 ones when they come out? :)

Hope the Buzz Lightyear worked out?

That IS annoying, what a shame.  At least you can get it off your chest and leave appropriate feedback (something clear like 'timewaster - kept me waiting for weeks then refunded and relisted it'?) to warn other buyers, but that won't stop you having lost on the exchange, or satisfy your family.  Most Ebay sellers are lovely people, like Redwoodsmama sounds like she is, but you do get the odd bad apple. >:(

 Good for you , defintily open a dispute. If you look at this seller's feedback, ON March 14th, 2010, it shows THEY BOUGHT A PLEO AND PAID ABOUT $138.00 OF IT, A NEW ONE, nOw they are trying to resell the same one, and apparently the same one you were supposed to buy, and maybe they did not get enough money on it, and so they are relisting it trying to get a higher bid, that is not just unethical, it is illegal. When did you buy this Pleo, what date, because on the Pleo they have listed now, there is nothing listed about them being away for awhile on Holiday. I would be very angry. Also does this seller have 56 or so feedback? If so we are looking at the same seller and they are really doing a rotten and crooked thing. Let ebay dispute try to settle the matter. Make sure you let them know that You still want the Pleo, they can['t relist it, or have another one listed without explaining what happened to YOURS. I WOULD THINK IF THEY LOST IT, AND IT IS NEW, THE ONE THEY HAVE NOW IS NEW SO THAT IS THE ONE THEY SHOULD SEND TO YOU WITH NO ADDED COST. DO NOT LEAVE NEGATIVE FEEDBACK TILL THIS MATTER IS SOLVED. DO NOT SETTLE FOR LESS THAN WHAT YOU DESERVE. I ASKED THIS SELLER A QUESTION, ASKING IF IT IS SEALED OR NOT, TRYING TO PRETEND I AM INTERESTED IN IT. Wow RWM, I didn't checked the feedback and see they bought a pleo.
Yes it is the same one. Nice spot. I have Pm'd you.

Edit: The seller expects me to wait for it... pay an extra $100 USD for postage because the postage was misquoted.

so I am meant to send another $190 USD (Note: I have lost $20 already or so) which means it will cost me another $20 due to the exchange rate being lower now than the original date of purchase plus the $100 USD.

So for a UGOBE model that was purchased a month ago on ebay for $130 USD approx they expect me to pay $290 USD pus lose probably $50 total on the exchange rate. which will probably work out about $370 Aussie for a pleo I can't even gurantee is new.  :o >:( They've offered me a little bit to cover what I lost but I am so angry with them right now. That is only if I accept not to take the item.

Don't take it Liddleone, for just a little over that you can have a brand new one with a warrenty (not to mention peace of mind). Find another seller and make sure ebay sorts it all out for you.

 Hi Liddleone, for all the f***** messages and " Misquotes" they have given you, your best option is to NOT TAKE THE PLEO, AND FILE THE DISPUTE SO YOU GET ALL YOUR MONEY BACK AS THE SELLER DID NOT OFFER THE ITEM AS PROMISED, AND IT IS CONSIDERED, " FALSE REPRESENTATION" iF AN ITEM IS NOT AS DESCRIBED, YOU ARE NOT MADE TO BUY THIS ITEM, Let ebay know what this seller did, demand ALL YOUR MONEY BACK FROM THIS SELLER AND THEN AFTER GETTING YOUR MONEY BACK, LEAVE NEGATIVE FEEDBACK, MAKE SURE YOU WARN OTHER BUYERS, TO BEWARE OF FALSE ADVERTISEMENT OF GOODS.
This is the best way to phrase it, that way you are not being nasty, but stating the facts. I was shocked when I saw that this seller had bought a Pleo and it is ok, to try and make money and resell it, but to sell it to you and make you go through all you did is Outrageous and Against Ebay Policy. what happened is that the Pleo went for a lower price than they found out they could get, or someone asked them if they would do a " buy it now for a higher price", so they gave you all this bull****, about being away on vacation, etc. Did you ever check their ebay sight to see if there was a statement from them about " being away on vacation"? If not, it is an out lie.
       Anyway, get your money back, all of it and Run as fast as you can, leave negative feedback letting others know of this sellers' unfair practice and buy a Brand New one like IMR suggested, or wait for a reputable dealer who has more feedback, 100% positive feedback, and who gives a Money back guarantee if anything is wrong, and check on the shipping charges to see if they are correct or not, It is sad that there are sellers like this in the world, but there are allways some rotten apples in the barrel, hopefullly they don't spoil the good apples. %) Did you pm me here on this site? If so thanks and I will check for it. Should I take the offer they offered to reimburse for the exchange rate? I agree going on vacation is a big lie how can they check postage is they are away?  %)

 Hi liddleone, there are some fishy things going on with this ebayer, for one, if you check their feedback, which is not all good, they mostly buy and not sell this being the last thing they tried to sell, and the Pleo they just had listed, I emailed a question about yesterday, asking if it was new, sealed, and they would not respond to me. NOw I checked on it again, and it is supposed to end tommrow, May 10th, 2010, and guess what. THEY ENDED IT EARLY,,, I THINK THEY ARE SCARED AND SOMETHING STINKS IF YOU KNOW WHAT I MEAN. I PHOTOCOPIED THE SALE PLAGE BECAUSE THEY WILL DELETE IT QUICKLY.
 I AM CHECKING ON SOME THINGS FOR YOU AND WILL PM YOU TOMMOROW. DONT DO ANYTHNG HASTY YET.
